Am I protected in an Uber or Lyft Case?
YES! … but it is important to first know some basic insurance terms.
Bodily Injury Coverage (or “BI”) pays for injuries a driver causes to OTHER people, including drivers, passengers and pedestrians.
Uninsured Motorist Coverage (“UM”) or Underinsured Motorist Coverage (“UIM”) pays for YOUR injuries if YOU are involved in a crash with an at-fault driver who doesn’t carry any BI Coverage or not enough BI Coverage.
The State of Florida is the ONLY State that does NOT require its drivers to carry liability insurance (BI) if they purchase car insurance. Crazy, right!? This makes it very important for anyone driving in Florida to purchase UM coverage. UM Coverage will provide protection if someone without adequate liability coverage crashes into you.
The State of Florida requires UBER to meet certain minimum mandatory insurance requirements to operate on their roadways. UBER is constantly lobbying legislature to decrease these minimum mandatory insurance limits which is bad for consumers. Recently, the State of Florida allowed UBER to reduce the limits of their minimum mandatory uninsured motorist coverage (UM/UIM) from $1,000,000.00 to $250,000.00 combined single limit. Combined single limit (“CSL”) is the maximum dollar amount that covers any combination of injuries or property damage in an incident. It would not surprise us if UBER/LYFT one day soon reduced their UM/UIM coverage to $0.00.
Here is the current breakdown of available insurance coverage. These limits apply assuming you are a passenger in the vehicle with the UBER (LYFT) app engaged.
You are involved in a crash where the UBER driver is at-fault:
While you are a passenger in an UBER and the UBER driver is at fault, UBER provides up to
$1,000,000.00 in BI coverage (CSL).
You are involved in a crash where the UBER driver is NOT at-fault (i.e. someone else is at fault)
While you are a passenger in an UBER and if the UBER driver is NOT at fault, UBER provides up to $250,000.00 (CSL) in UM coverage, if the at-fault driver has no BI insurance (or insufficient BI insurance).
UBER/LYFT also provides up to a $250,000.00 (CSL) in UM coverage if you’re involved in a hit-and-run.
It would not surprise us, however, if UBER/LYFT one day soon reduced their UM/UIM coverage to $0.00.
If you are driving for UBER/LYFT your recovery is now capped at $250,000.00.
Please note that UBER XL and UBER Black are governed under different insurance requirements. They are considered “commercial vehicles” and are not required to have mandatory minimum UM benefits.
In the event that UBER’s insurance benefits are inadequate for your particular claim, your personal UM coverage would potentially apply as secondary coverage.
The bottom line is that UBER and LYFT provide coverage in the event you are involved in a crash. Over time, however, these benefits may erode away through lobbying efforts by UBER and LYFT. You should consider purchasing UM coverage to protect yourself and your family from the large number of uninsured drivers throughout Florida.
